Welcome to Whysual. By accessing or using our services, you agree to be bound by these Terms of Service ("Terms"). Please read them carefully.

1. Acceptance of Terms

By accessing or using Whysual's mobile application, website, or related services (collectively, the "Services"), you agree to be bound by these Terms and our Privacy Policy. If you don't agree to these Terms, you may not use our Services.

2. Description of Services

Whysual provides an AI-powered execution layer for goal management and project execution, including but not limited to:

  • Dynamic dependency mapping for goals and tasks
  • Fog of Focus filtering and prioritization
  • Reality-sync verification and plan adjustment
  • AI credit-based features and task execution
  • Mobile application (Android/iOS) and web platform
  • Cross-device synchronization and offline functionality
  • Team collaboration and shared blueprints

3. Account Registration

To use our Services, you must:

  • Be at least 13 years old (or the age of digital consent in your jurisdiction)
  • Provide accurate and complete registration information
  • Maintain the security of your account credentials
  • Notify us immediately of any unauthorized access
  • Use the Services for legitimate goal management and execution purposes

You are responsible for all activities that occur under your account.

4. Acceptable Use Policy

You agree NOT to use our Services to:

  • Violate any applicable laws or regulations
  • Infringe on intellectual property rights
  • Generate harmful, illegal, or offensive content
  • Attempt to reverse engineer or extract our AI models
  • Exceed rate limits or abuse the application
  • Impersonate others or provide false information
  • Distribute malware or engage in phishing
  • Scrape or harvest data without permission
  • Use the Services for surveillance or tracking without consent
  • Share your AI credits or account access with others

Prohibited Content:

You may not use our Services to create goals or tasks that:

  • Promote violence, hatred, or discrimination
  • Facilitate illegal activities
  • Spread misinformation
  • Harass or threaten individuals
  • Violate privacy or confidentiality

5. Billing and Payment

Free Tier (€0/forever):

  • 3 active journeys
  • 50 AI credits per month
  • Basic roadmap templates
  • Earn credits through reward ads
  • May be modified or discontinued at any time
  • No service level agreement (SLA)

Pro Plan (€12/month):

  • Unlimited journeys
  • 1,500 AI credits per month
  • Premium features (Reality-sync, Fog of Focus, Media verification)
  • Priority support
  • Billed monthly or annually as selected
  • Payments are non-refundable except as required by law

Team Plan (€25/seat/month):

  • Unlimited journeys per member
  • 3,000 AI credits per seat per month
  • Team collaboration for up to 30 people
  • Shared blueprint libraries
  • Custom integrations available
  • Dedicated support
  • Centralized billing

General Billing Terms:

  • You authorize automatic billing to your payment method
  • Prices may change with 30 days' notice
  • Failure to pay may result in service suspension
  • Unused AI credits do not carry over between months
  • Free tier users can upgrade anytime

6. Intellectual Property

Your Content (Goals, Tasks, Journeys):

  • You retain all rights to your goals, tasks, journeys, and journey data
  • You grant us a limited license to process your data to provide Services
  • We do not use your personal journey data for training our AI models
  • You may export or delete your data at any time
  • For Team plans, shared data is accessible to authorized team members only

Our IP:

  • Whysual retains all rights to our AI technology, algorithms, and platform
  • Our branding, logos, and trademarks remain our exclusive property
  • You may not reverse engineer or extract our AI models
  • You may not use our IP without explicit written permission

7. Service Level and Support

Service Availability:

  • Free tier: No uptime guarantee
  • Pro tier: Best-effort support
  • Team tier: Priority support and higher reliability

Support:

  • Free: Community support via email
  • Pro: Email support (24-hour response time)
  • Team: Priority support (12-hour response time)

8. Offline Functionality and Sync

Whysual is designed with offline-first functionality:

  • Core execution features work offline and sync when connected
  • AI-powered features (dependency mapping, Fog of Focus) require internet connection
  • We are not responsible for data loss due to device storage issues
  • Regular backups are recommended for important journeys

9. Data and Privacy

Your use of our Services is also governed by our Privacy Policy. Key points:

  • We do not use your journey data to train our AI models
  • You can delete your account and all associated data at any time
  • We implement industry-standard security measures
  • We comply with GDPR, CCPA, and other data protection laws
  • Team data is only shared with authorized team members

10. Termination

By You:

You may terminate your account at any time through your account settings or by contacting support. Paid subscriptions will continue until the end of the billing period unless canceled before renewal. All journey data will be deleted 30 days after account termination.

By Us:

We may suspend or terminate your access if you:

  • Violate these Terms
  • Engage in fraudulent activity or abuse
  • Fail to pay amounts owed
  • Create risk or legal exposure for us
  • Violate the Acceptable Use Policy

We will provide notice when reasonably possible.

11. Disclaimers

The Services are provided "as is" and "as available" without warranties of any kind, either express or implied. We disclaim all warranties, including:

  • Merchantability and fitness for a particular purpose
  • Accuracy, reliability, or completeness of AI-generated roadmaps
  • Uninterrupted or error-free operation
  • Security or freedom from viruses
  • That features will always work as expected

AI-generated dependency mappings and recommendations may contain errors or biases. You are responsible for reviewing and validating all suggestions before acting on them.

12. Limitation of Liability

To the maximum extent permitted by law, Whysual shall not be liable for:

  • Indirect, incidental, or consequential damages
  • Loss of data, journeys, or business opportunities
  • Damages exceeding amounts paid to us in the past 12 months
  • Service interruptions or unplanned downtime

13. Indemnification

You agree to indemnify and hold Whysual harmless from any claims, damages, or expenses (including legal fees) arising from:

  • Your use of the Services
  • Your violation of these Terms
  • Your violation of any rights of another party
  • Content you create or journeys you define using our Services
  • Your use of journeys or data shared by team members

14. Changes to Terms

We may modify these Terms at any time. We will notify you of material changes via email or through the Services. Continued use after changes constitutes acceptance. If you don't agree to changes, you must stop using the Services and can request account deletion.

15. Governing Law

These Terms are governed by applicable international law and the laws of the jurisdiction where Whysual is registered. Any disputes will be handled through binding arbitration or, if required by local law, in local courts.

16. Dispute Resolution

Informal Resolution:

Before filing any claim, you agree to contact us at support@whysual.com to attempt to resolve the dispute informally.

Arbitration:

For disputes that cannot be resolved informally, you agree to binding arbitration. You waive your right to a jury trial and class actions.

17. General Provisions

  • Entire Agreement: These Terms constitute the entire agreement between you and Whysual
  • Severability: If any provision is found unenforceable, the rest remains in effect
  • Assignment: You may not assign these Terms; we may assign them without restriction
  • No Waiver: Our failure to enforce a right doesn't waive that right
  • Force Majeure: We're not liable for delays due to circumstances beyond our control
